Read this ‘TERMS & OF USE AGREEMENT ’ before accessing website; This Terms of Use Agreement sets forth the standards of use of the PhotoSkills Online Service. By using the www.photoskills.com.au website you (the “Member”) agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted at www.picsource.com.au / www.photoskills.com.au website. Your continued use of the Service after amendments are posted constitutes an acknowledgment and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended. Disclaimer of Warranties The site is provided by PhotoSkills on an “as is” and on an “as available” basis. To the fullest extent permitted by applicable law, PhotoSkills makes no representations or warranties of any kind, express or implied, regarding the use or the results of this web site in terms of its correctness, accuracy, reliability, or otherwise. PhotoSkills shall have no liability for any interruptions in the use of this Website. PhotoSkills disclaims all warranties with regard to the information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, therefore the above-referenced exclusion is inapplicable. Indemnification Member agrees to indemnify and hold PhotoSkills, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of Member’s use of the Service, the violation of this Agreement, or infringement by Member, or other user of the Service using Member’s computer, of any intellectual property or any other right of any person or entity. Modifications and Interruption to Service PhotoSkills reserves the right to modify or discontinue the Service with or without notice to the Member. PhotoSkills shall not be liable to Member or any third party should PhotoSkills exercise its right to modify or discontinue the Service. Member acknowledges and accepts that PhotoSkills does not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control. Third-Party Sites Our website may include links to other sites on the Internet that are owned and operated by online merchants and other third parties. You acknowledge that we are not responsible for the availability of, or the content located on or through, any third-party site. Compliance with Laws Member assumes all knowledge of applicable law and is responsible for compliance with any such laws. Member may not use the Service in any way that violates applicable state, federal, or international laws, regulations or other government requirements. Member further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation. Order Acceptance Policy When you place an order/booking on this site you will receive Email confirmation that PhotoSkills has received your order/booking. Your receipt of an electronic or other form of order confirmation does not signify PhotoSkills acceptance or confirmation of your order/booking. PhotoSkills reserves the right at any time after receipt of your order to accept, decline, or limit your order/booking for any reason, whether or not your credit card has been charged. If your credit card has been charged and your order is cancelled before it has been produced or entered into the production process or a booking cancelled before the booking deadline date, you will receive a prompt refund credit to your account. PhotoSkills reserves the right, at any time after receipt of your order, to supply less than the quantity you ordered of any item. PhotoSkills may require additional verifications or information before accepting any order. Price and availability of photographs and other products and services offered on this site are subject to change without prior notice. Return Policy If you are not completely satisfied with any of our products when you receive them, please contact PhotoSkills regarding our return policy. We will instruct you how to return goods for replacement or the proper credit. PhotoSkills works cooperatively to ensure that all goods produced by us are acceptable to the customer. Shipping Policy Items you order will be shipped as per the delivery/shipping options you select on our site. Shipping and handling charges are determined by PhotoSkills and are charged to you at the time you place your order in accordance with PhotoSkills pricing policies. PhotoSkills accepts no responsibility whatsoever for loss or damage to purchases once the goods are in the hands of the delivery/shipping company. Goods & Services Tax PhotoSkills charges a Goods and Services Tax (GST) of 10% on all sales to Australian addresses, including shipping and handling charges. GST is included in the total order price unless otherwise stated. Other Terms If any provision of this Terms of Use Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. You agree that this Terms of Use Agreement and any other agreements referenced herein may be assigned by PhotoSkills, in our sole discretion, to a third party in the event of a merger or acquisition. This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a Member. Member agrees that by accepting this Terms of Use Agreement, Member is consenting to the use and disclosure of their personally identifiable information and other practices described in our Privacy Policy Statement. Section 2. TERMS & CONDITIONS for PhotoSkills Photography Training Services Group Courses and Workshops ("group course/s") Fees The group course cost includes the tuition fee and catering arrangements as stated in the group course brochure. All other expenses are the responsibility of the group course participants. Travel & Transport All participants are responsible for making their own way to group courses. Transport during group courses will be provided as detailed in our promotional material. Refund Policy To secure your place in a group course we require full payment at the time of booking. If for any reason you need to cancel your participation in a group course please notify us at least 14 days before the start. At that time, we will refund your group course payment less a $20 cancellation/administration fee. If notification of cancellation is made less than 14 days before the start of a workshop, we will retain the group course fee (unless the vacant spot can be filled). PhotoSkills reserve the right to cancel any group course with inadequate enrolment up to 7 days beforehand. In the event that a group course is cancelled due to inadequate enrolment, all fees and deposits paid are refunded in full or transferred to an alternative group course within 3 months of the transfer. Cancelled Group Courses PhotoSkills will endeavour to ensure that all scheduled courses go ahead but reserves the right to cancel any group course for any reason whatsoever, including too few participants or logistical problems such as strikes, wars, acts of God, or any other circumstances, which may make operation of the group course inadvisable. All group course payments, which were received, will be promptly refunded. This refund will be the limit of PhotoSkills liability. PhotoSkills is not responsible for any expenses or damages incurred by group course participants as a consequence of any cancellation, such as costs expended in preparing for the course including special clothing, lost income, accommodation and travel bookings or any other course-related losses or expenses. Physical Fitness Our group courses may be undertaken by anyone in reasonably good physical condition. During our group courses you will be doing some walking up and down stairs, photographing outside including walking and carrying photo equipment. Please call us if you have any questions about your ability to do a particular course. Once a course has started and it is necessary for you to leave because it is beyond your physical level, please note that there will be no refunds for any unused portion of the course. Medical You must be in generally good health and it is vital that persons with medical problems make them known to us well before the group course begins. It is understood that PhotoSkills is not a medical facility and therefore has no expertise or responsibility regarding your particular medical situation. PhotoSkills assumes no liability regarding provision of medical care. Limitation of Liability of PhotoSkills This section defines our responsibility with respect to all of our group courses. PLEASE READ IT CAREFULLY. Payment of your group course fee represents your acceptance of all terms and conditions outlined anywhere within this website or in our brochure. PhotoSkills shall have no liability for any damages, losses, or expenses of whatever cause or nature, including those resulting directly or indirectly from acts of God, detention, annoyance, weather, quarantines, strikes, civil disturbance, theft or criminal activity of any kind, government regulations, etc., over which it has no control. Without limiting the above paragraph, PhotoSkills shall have no responsibility for additional expenses due to unforeseen delays caused by weather, theft or criminal activity of any kind, political disputes, acts of terrorism, strikes, sickness, failure of flights or other transportation to arrive or depart on time, and other causes beyond our control. PhotoSkills cannot assume any responsibility for loss or damage to personal property. IN NO EVENT SHALL PHOTOSKILLS HAVE ANY LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, HOWEVER CHARACTERIZED. PhotoSkills reserves the right to cancel any group course prior to the starting date upon the refund of all payments received, which shall release PhotoSkills from further liability. PhotoSkills is not responsible for additional expenses incurred by group course participants in preparing for the course. (i.e. nonrefundable advance-purchase accommodation, equipment, etc.) PhotoSkills reserves the right to decline to accept or retain any person or member of any group course should such person’s actions or general behaviour impede the operation of the course or the rights or welfare or enjoyment of other course participants, and it is agreed that no refunds will be given in such circumstances. PhotoSkills reserves the right to take photographic or video records of any of our group courses and may use any such records for promotional and/or commercial purposes. Section 3. TERMS & CONDITIONS for PhotoSkills Photography Training Services On-line Courses ("on-line course/s") Fees Online course fees cover access to or delivery of course information and material, and tutor follow-up and advice as detailed in course promotional material or on our website.
